The Expert Council on NGO Law has just published an opinion examining the compatibility with European standards of the main changes in recently adopted and planned legislative provisions with respect to the functioning and activities of NGOs in Russia. The changes involve extending the scope of the category of “foreign agent”, modifying their operation regime, imposing certain prohibitions on their activities and establishing other obstacles to their functioning.
These changes are problematic on account of the speed of their adoption, the imprecision of many concepts used in them, the lack of an evidential basis for the purported aims and the disproportionate nature of the changes and the penalties for non-compliance with them.
The Expert Council on NGO law and the President of the Conference of INGOs are calling upon the members of the State Duma not to adopt the proposed changes still under consideration and to reverse those that have already been adopted.

Le Conseil d’experts sur le droit des ONG vient de publier un avis examinant la compatibilité avec les normes européennes des principaux changements apportés aux dispositions législatives récemment adoptées et prévues concernant le fonctionnement et les activités des ONG en Russie.
Les changements consistent à étendre le champ d’application de la catégorie des «agents étrangers», à modifier leur régime d’exploitation, à imposer certaines interdictions à leurs activités et à établir d’autres obstacles à leur fonctionnement.
Ces changements sont problématiques en raison de la rapidité de leur adoption, de l’imprécision de nombreux concepts qui y sont utilisés, de l’absence de base probante pour les objectifs prétendus et du caractère disproportionné des changements et des sanctions en cas de non-respect de ceux-ci. Le Conseil d’experts sur le droit des ONG et le Président de la Conférence des OING appellent les membres de la Douma d’État à ne pas adopter les modifications proposées encore à l’étude et à annuler celles qui ont déjà été adoptées.
